Default having been made in the terms, conditions, and payments, including without limitation the failure to make principal and interest payments, provided for in that certain Deed of Trust dated May 5, 2015, as recorded in Book 6451, Page 164, in the Register’s Office of Williamson County Tennessee, from Thomas Ovation, LLC, a Georgia limited liability company (“Borrower”), to R. Kirkland Moser, Trustee, securing the indebtedness therein described (as amended, the “Deed of Trust”), which indebtedness is now due and unpaid, and has been declared in default by the lawful owner and holder thereof;


The undersigned, Nathaniel F. Greene, Substitute Co-Trustee, having been appointed Substitute Co-Trustee on April 13, 2017 to serve in the place and stead of R. Kirkland Moser, Trustee, said appointment being recorded at Book Number 7051, Page 660 in the Register’s Office for Williamson County, Tennessee;


NOW, THEREFORE, I, Nathaniel F. Greene, Substitute Co-Trustee, pursuant to said Deed of Trust, having been requested by Ovation Loan Group, LLC, a Delaware limited liability company, the owner and holder of said indebtedness, so to do, and by virtue of the authority and power vested in me by said Deed of Trust will, on June 28, 2019 at 12:00 o’clock noon at the south front door of the Williamson County Judicial Center, 135 4th Avenue South,  Franklin, Williamson County, Tennessee, proceed to sell at public outcry to the highest bidder for cash (or credit upon the indebtedness secured if the lawful owner and holder thereof is the successful purchaser), free from the equity of redemption, the statutory right of redemption, homestead, elective share, and all other exemptions of Borrower of every kind, all of which have been expressly waived by Borrower in said Deed of Trust, the property in Williamson County, Tennessee described as follows:


Lot(s) 1, 6 and 7, as shown on the map entitled Ovation Resubdivision, of record in Plat Book P60, Page 95, Revised in Plat Book P61, Page 39, Register’s Office for Williamson County, Tennessee, to which plan reference is hereby made for a more complete and accurate legal description.


Being the property conveyed to Thomas Ovation, LLC, a Georgia limited liability company, by Deed of record in Book 6451, Page 142, in the Register’s Office of Williamson County, Tennessee.


The above described real estate is known as Ovation Pkwy Pvt, Franklin, Williamson County, Tennessee.


The map and parcel numbers for the above described real estate are 062-018.11, 062-018.06, and 062-018.13.


The present owner of the above described real estate is Thomas Ovation, LLC, a Georgia limited liability company.


This sale is made subject to matters shown on the Final Plat, Ovation Resubdivision Final Plat Revision 2, of record in Plat Book 69, page 42 Register’s Office for Williamson County, Tennessee and all liens, easements, encumbrances, real estate taxes, personal property taxes, rights of redemption of taxing entities and other matters which are prior in right to the lien of the aforesaid Deed of Trust.  


The following parties may have liens against or claim an interest in the above described property which will be extinguished or adversely affected by the sale: SS McEwen, LLC, Williamson County, Highwoods Realty Limited Partnership, Ovation Loan Group, LLC, Tennessee Department of Revenue, CPR Money LLC, and any and all parties whose interest is junior to the lien of the aforementioned Deed of Trust.  This sale shall be subject to the right of redemption by the Tennessee Department of Revenue, Tax Enforcement Division, pursuant to T.C.A. 67-1-1433(c)(1) by reason of the tax lien of record in Book 7175, Page 830 in the Register’s Office of Williamson County, Tennessee.  Notice of this sale has been given to the State of Tennessee in accordance with T.C.A. 67-1-1433(B)(1). The Substitute Co-Trustee may adjourn or postpone the aforementioned sale of real property without further publication by public announcement at such time and place of sale, and from time to time thereafter may postpone such sale by public announcement at the time and place fixed by the preceding postponement or subsequently noticed sale, and without further notice make such sale at the time fixed by the last postponement, or may, in his discretion, give a new notice of sale.
