NOTICE  OF SUBSTITUTE  TRUSTEE’S  SALE

 

WHEREAS, Stephen Highsmith and wife, Dana Highsmith by Deed of Trust (the “Deed of Trust”), dated June 15, 2005 and of record in Deed Book 3597, Page 818, Register’s Office of Williamson County, Tennessee, conveyed to Advantage Title, Trustee the hereinafter described real property to secure the payment of a certain Promissory Note (the “Note”) described in the Deed of Trust, which Note was payable to Mortgage Electronic Registration Systems, Inc. (“MERS”) as nominee for Fremont Investment & Loan, as last transferred to Deutsche Bank National Trust Company, as Trustee for Carrington Mortgage Loan Trust, Series 2005-FRE1 Asset-Backed Pass-Through Certificates by Assignment recorded in Book 5310, Page 125, Williamson County, Tennessee, Register of Deeds, and

 

WHEREAS, Mantenn, LLC has been duly appointed Substitute Trustee by the owner and holder of the

Note by instrument recorded in Deed Book 7537, Page 142, Williamson County, Tennessee

 

WHEREAS, default has been made in the payment of the Note; and

 

WHEREAS, the owner and holder of the Note has demanded that the hereinafter described real property be advertised and sold in satisfaction of the indebtedness and costs of foreclosure in accordance with the terms and provisions of the Note and Deed of Trust. The notice requirements of T.C.A. §35-5-117 have been satisfied.

 

NOW, THEREFORE, notice is hereby given that an agent of Mantenn, LLC, Substitute Trustee, pursuant to the power, duty, and authority vested in and conferred by the Deed of Trust, will June 13, 2019, at 12:00 p.m. on the Front steps of Williamson County Courthouse in Franklin, Tennessee be sold to the highest call bidder for cash free from all legal, equitable and statutory rights of redemption, exemptions of homestead, rights by virtue of marriage, and all other exemptions of every kind, all of which have been waived in the Deed of Trust, certain real property located in Williamson County, Tennessee, described as follows:

Land in the 1st Civil District of Williamson County, Tennessee being more particularly described as follows: Beginning at a steel post in the south right of way of Henry Road, said steel post being the northwesterly

corner of Andrew’s as of record in Deed Book 1505, Page 351, Register’s Office for Williamson County,

Tennessee (ROWC) and being the northeasterly corner of said herein described tract.

 

Thence leaving Henry Road, South 20 degrees 39 minutes 25 seconds East 160.81 feet to a point. Thence South 29 degrees 56 minutes 44 seconds East 159.53 feet to a point. Thence South 80 degrees 36 minutes 41 seconds East, 25.85 feet to a point. Thence South 28 degrees 55 minutes 30 seconds East 244.30 feet to a point, said point being the southeasterly corner of herein described tract. Thence North 87 degrees 00 minute

00 second West 150.00 feet to a point, said point being the southwesterly corner of said herein described tract. Thence North 35 degrees 45 minutes 30 seconds West 520.26 feet to a point in the south right-of-way of Henry Road, said point being the northwesterly corner of said herein described tract. Thence with said right-of-way of Henry Road North 66 degrees 11 minutes 00 second East 190.00 feet to the point of beginning and containing

1.83 acres more or less.

 

Being the same property conveyed to Stephen Highsmith and wife, Dana Highsmith, by deed of record in

Book 3597, Page 816, Register’s Office for Williamson County, Tennessee.

 

The street address of the above described property is believed to be 7313 Henry Road, Fairwview, TN

37052, but if such address is not part of the legal description of the property sold herein and in the event of any discrepancy, the legal description herein shall control.

This sale is subject to all matters shown on any applicable recorded plat; any unpaid taxes; any restrictive covenants, easements or setback lines that may be applicable; any statutory rights of redemption of any governmental agency, state or federal; any prior liens or encumbrances as well as any priority created by a fixture filing; and to any matter that an accurate survey of the premises might disclose.

 

All right of equity of redemption, statutory and otherwise, and homestead are expressly waived in said Deed of Trust, and the title is believed to be good, but the undersigned will sell and convey only as Substitute Trustee. The right is reserved to adjourn the day of the sale to another day, time, and place certain without further publication, upon announcement at the time and place for the sale set forth above.
