Hardiman Revocable Living Trust; DISCOVER BANK; PHOENIX CREDIT, LLC; and THE BANK OF NEW YORK MELLON FKA THE BANK OF NEW YORK, AS TRUSTEE FOR THE CERTIFICATEHOLDERS OF CWMBS, INC., CHL MORTGAGE PASS-THROUGH TRUST 2004-15, MORTGAGE PASS THROUGH CERTIFICATES, SE-RIES 2004-15, Case No 21CV-50472 ORDER FOR SERVICE BY PUBLICATION   Pursuant to T.C.A § 21-1-204, appearing from the allegations of the Complaint in this cause, and the Plaintiff’s Motion for Service by Publication, and being duly sworn to, that Defendants Julia A. Boyd, in her capacity as Co-Trustee of The Detra D. Hardiman Revocable Living Trust, DeAnna Annette Dubose, in her capacity as Co-Trustee of The Detra D. Hardiman Revocable Living Trust, Derrick Jerrold Becton, in his capacity as Co-Trustee of The Detra D. Hardiman Revocable Living Trust and Detra D. Hardiman (“Defendants”) cannot be served with the ordinary process of law for the reason that after diligent inquiry, as shown by the affidavit submitted by Plaintiff’s counsel, it has been confirmed that Defendants are unable to be located. Further, the affidavit details Plaintiff’s good-faith attempts to serve Defendants to no avail. The Court finds that the Motion has been brought in good faith and that Defendants’ whereabouts are not known and that service via publication pursuant to T.C.A § 21-1-204 is warranted. TO:  Julia A. Boyd, in her capacity as Co-Trustee of The Detra D. Hardiman Revocable Living Trust, DeAnna Annette Dubose, in her capacity as Co-Trustee of The Detra D. Hardiman Revocable Living Trust, Derrick Jerrold Becton, in his capacity as Co-Trustee of The Detra D. Hardiman Revocable Living Trust and Detra D. Hardiman. It is therefore ORDERED, that said Defendants shall enter an appearance 30 days after the last publication and file an answer to the complaint, or judgment by default may be taken against them for the relief demanded in the Complaint.
